(Curtis Means\/Pool Photo via AP, file)<\/small><\/p>\n<p>2026-05-18T14:01:22Z<\/p>\n<p>NEW YORK (AP) \u2014 A gun and notebook that prosecutors say link <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/unitedhealthcare-ceo-brian-thompson-shooting-79a9710978fc7adbb23d3fed4ea2f70d\">Luigi Mangione<\/a><\/span> to the killing of <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/united-healthcare-ceo-new-york-shooting-brian-thompson-8a130e64bcab749d1a085f5a34ab8254\">UnitedHealthcare CEO Brian Thompson<\/a><\/span> can be used as evidence at his murder trial, a judge ruled Monday, rejecting a defense argument that they were seized illegally, before a search warrant was obtained.<\/p>\n<p>Judge Gregory Carro\u2019s decision, five months after he held a hearing to examine how police came upon the items, is a major win for prosecutors, enabling them to show the jury a possible murder weapon and evidence they say points to motive. That mirrors an earlier ruling in <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/judge%20previously%20ruled%20to%20allow%20the%20items\/\" target=\"_blank\" rel=\"noopener\">Mangione\u2019s federal case<\/a><\/span>.<\/p>\n<p>The judge allowed evidence obtained during a subsequent inventory of his backpack at the police station, but said evidence found during an initial search of Mangione\u2019s backpack during his arrest at a McDonald\u2019s restaurant must be suppressed, including a gun ammunition magazine, cellphone, passport, wallet and computer chip. \u201cI find that the search of backpack at the McDonald\u2019s was an improper warrantless search,\u201d the judge said.<\/p>\n<p><span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/mangione-unitedhealthcare-trial-manhattan-delay-179a4299cf7677098bf363f544c69846\">Mangione\u2019s state murder trial<\/a><\/span> is set to begin on Sept. 8. Jury selection for his federal trial, which involves stalking charges, is scheduled to start on Oct. 13, with opening statements and testimony beginning on Nov. 4. The state trial is expected to take four to six weeks.<\/p>\n<p>Mangione, 28, has pleaded not guilty in both cases. He faces the possibility of life in prison if he is convicted in either one.<\/p>\n<h2>Both sides win something in this ruling<\/h2>\n<p>Police found the gun, notebook and other items in Mangione\u2019s backpack after he was spotted eating breakfast at a McDonald\u2019s restaurant in Altoona, Pennsylvania, on Dec. 9, 2024, five days after <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/live\/unitedhealthcare-ceo-brian-thompson-updates-day-3\">Thompson was killed outside a Manhattan hotel<\/a><\/span>. Altoona is about 230 miles (370 kilometers) west of Manhattan.<\/p>\n<p>The gun, a 3D-printed pistol, matches the one used to kill Thompson, prosecutors said. The notebook, which prosecutors have termed as a \u201cmanifesto,\u201d describes wanting to \u201cwack\u201d a health insurance executive and rebelling against \u201cthe deadly, greed fueled health insurance cartel.\u201d<\/p>\n<p><span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/mangione-unitedhealthcare-killing-evidence-hearing-77d3b2add7f95341de179f31559eaba1\">Mangione\u2019s lawyers argued that the search was illegal<\/a><\/span> and that the items should be excluded from his trial because police officers looked through the backpack before obtaining a warrant.<\/p>\n<p>    <a><\/a><\/p>\n<p>    <!-- AP \"Read More\" embed (place mid-article) --><\/p>\n<p>  <button type=\"button\" aria-expanded=\"false\"><br \/>\n    Read More <span aria-hidden=\"true\"><\/span><br \/>\n  <\/button><\/p>\n<p>Prosecutors maintain the search was legal because it was conducted in conjunction with an arrest and officers were following Altoona police protocols that require them to check for dangerous items that could be harmful to them or the public. Police eventually obtained a warrant, prosecutors said.<\/p>\n<p>Mangione\u2019s statements to police prior to his arrest matter mainly because, as shown on body-worn camera video, he initially gave officers a fake name, Mark Rosario. He eventually acknowledged the ruse and gave his real name after police checked his phony New Jersey driver\u2019s license against a computer database.<\/p>\n<p>The fake name promptly gave Altoona police a reason to arrest him and hold him for New York City police.<\/p>\n<p>\u201cIf he had provided us with his actual name, he would not have committed a crime,\u201d Officer Stephen Fox testified. An NYPD lieutenant testified that the Rosario name matched one the suspected shooter used to purchase a bus ticket to New York and gave at a Manhattan hostel.<\/p>\n<p>Mangione <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/luigi-mangione-unitedhealthcare-ceo-nyc-case-a724cc3dd69b5b27e893449f8aec04c3\">told police early on he didn\u2019t want to talk<\/a><\/span>, but officers <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/luigi-mangione-unitedhealthcare-evidence-ceo-hearing-c04ec05de553f1399a8ff1c9ae06d6fc\">engaged him for almost 20 minutes<\/a><\/span> before getting him to admit to lying about his name. After that, a supervisor urged Fox to inform Mangione of his right to remain silent.<\/p>\n<h2>What must police tell suspects during arrests?<\/h2>\n<p>An important factor in whether suspects have to be read those rights \u2014 known as a Miranda warning \u2014 is whether they are in police custody.<\/p>\n<p>Surveillance video showed a masked gunman shooting Thompson from behind on Dec. 4, 2024, as he walked his company\u2019s annual investor conference at the New York Hilton Midtown. Police say \u201cdelay,\u201d \u201cdeny\u201d and \u201cdepose\u201d were written on the ammunition, mimicking a phrase used to describe how insurers avoid paying claims.<\/p>\n<p>At a three-week hearing in December, Altoona police officers described how they conducted Mangione\u2019s arrest and searched his backpack. Prosecutors also played body-worn camera <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/mangione-unitedhealthcare-pretrial-hearing-evidence-1c5b61d3c160d48c9ad85b6c359203d8\">video of Mangione\u2018s arrest in court for the first time<\/a><\/span>, and some clips were made public.<\/p>\n<p>Carro had said he planned to study the body-camera video before issuing a decision.<\/p>\n<p>According to the testimony and video, officers began searching the bag at the McDonald\u2019s but stopped after finding a loaded gun magazine wrapped in a pair of underwear. That discovery appeared to confirm their suspicions that Mangione was the man wanted for Thompson\u2019s killing.<\/p>\n<p>\u201cIt\u2019s him, dude. It\u2019s him, 100%,\u201d Fox said on video, punctuating the remark with expletives as the officer searching the bag, Christy Wasser, held up the magazine.<\/p>\n<p>Officers continued searching the bag at a police station and found the gun and silencer.<\/p>\n<p>They performed what\u2019s known as an inventory search and found the notebook and other notes, including what appeared to be to-do lists and possible getaway plans, according to testimony.<\/p>\n<p>That search, which involves cataloging every piece of a suspect\u2019s seized property, is also required under Altoona police policy, prosecutors said. The judicial warrant was obtained hours later. Laws concerning how police obtain search warrants are complex and often disputed in criminal cases.<\/p>\n<p>Prosecutors have <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/mangione-unitedhealthcare-hearing-evidence-notes-e5a3881ad73960f7bc32162f427ddcd5\">quoted extensively from Mangione\u2019s handwritten diary<\/a><\/span> in court filings including his praise for Unabomber Ted Kaczynski.<\/p>\n<p>        <a href=\"https:\/\/apnews.com\/author\/michael-r-sisak\"><\/a><\/p>\n<p>        <\/p>\n<p>                <a href=\"https:\/\/apnews.com\/author\/michael-r-sisak\">MICHAEL R.
