(AP Photo\/David Zalubowski, File)<\/small><\/p>\n<p>2026-09-03T10:25:30Z<\/p>\n<p>A federal judge in Boston will hear arguments Thursday on whether to <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-executive-order-elections-midterms-voting-rights-159c192e48670a8740a6a378c683cb61\">extend her prohibition<\/a><\/span> against the U.S. Postal Service requiring states to use a new mail balloting system for the midterms as part of <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/donald-trump-mail-voting-elections-47cc334b1fb7742244a9c4f176b355cd\">an executive order<\/a><\/span> by President Donald Trump.<\/p>\n<p>The hearing in the closely watched case comes the day before the first state begins sending mail ballots to voters.<\/p>\n<p>U.S. District Court Judge Indira Talwani is considering whether to order a preliminary injunction that would bar the Postal Service from requiring the new system to be used for the midterms. Last week, she imposed a 14-day <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-voting-mail-ballots-democrats-lawsuits-15cf1ec7dcdb8211bf6b624b75a7f4ab\">temporary restraining order<\/a><\/span> to keep it from being used. That order expires next week as more states begin sending out mail ballots.<\/p>\n<p>Talwani has been here before. In June, she <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-executive-order-elections-mail-voting-b28c3425c1dc968cd0f57c61fb7a684e\">prohibited the administration<\/a><\/span> from trying to implement Trump\u2019s order for the November election, ruling the changes came too close to the election for the federal government to embark on such a project. But the <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-mail-voting-supreme-court-157afc3c195ce0a62c522da5ce904b04\">Supreme Court<\/a><\/span> late last month ruled that Talwani\u2019s order was premature because the Postal Service had not yet published regulations governing how it would apply Trump\u2019s order. <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/postal-service-midterms-trump-mail-voting-b4b9ef095b4d6bceab18adbb34814640\">The agency did so<\/a><\/span> just before the high court ruling came down, prompting Democrats and voting rights groups to swiftly re-file their lawsuits.<\/p>\n<p>They counter that the president has no authority to set election rules, which is a power designated in the Constitution to the states and in some cases Congress.<\/p>\n<p>They won an initial victory with Talwani\u2019s restraining order, which has already been <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-voting-mail-ballots-midterms-executive-order-8ef4a669a50f3406481ffb8387ccad3c\">appealed by the administration<\/a><\/span>. It\u2019s likely the case will again end up before the Supreme Court.<\/p>\n<p>Trump has <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/f0a5b003db26dbb19778bcdcb45f9a3f\">long opposed mail voting<\/a><\/span> and <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/virus-outbreak-joe-biden-election-2020-donald-trump-elections-3e8170c3348ce3719d4bc7182146b582\">falsely blamed it<\/a><\/span> for his 2020 election loss to Democrat Joe Biden, even though he often <span><a data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/donald-trump-vote-by-mail-bd52fd205f4484237d5b77d2e7319350\">uses that method<\/a><\/span> to cast his own ballot.<\/p>\n<p>    <a><\/a><\/p>\n<p>    <!-- AP \"Read More\" embed (place mid-article) --><\/p>\n<p>  <button type=\"button\" aria-expanded=\"false\"><br \/>\n    Read More <span aria-hidden=\"true\"><\/span><br \/>\n  <\/button><\/p>\n<p>Election officials say there\u2019s simply no way they can comply with the Postal Service directives, which could require a complete overhaul of their operations. A few municipalities in Wisconsin opted to send mail ballots to voters earlier this week, but Friday marks the full kickoff of voting as North Carolina starts shipping its mail ballots to all voters who requested them.<\/p>\n<p>The administration has contended the changes are relatively minor and legal.
